In the new discussion paper of Analitika, judge Ljiljana Filipović discusses the issue of quality of indictments and verdicts as a feature of efficiency of the judiciary. In doing so, judge Filipović offers an overview of international standards related to the quality of indictments and verdicts and focuses on the question of whether the domestic criminal justice legislation provides the required level of quality of indictments and verdicts. Furthermore, the author analyses quality of 50 randomly selected indictments and verdicts for corruption-related crimes from all parts of Bosnia and Herzegovina, that have become final in 2015. In a convincing and reasoned analysis, judge Filipović concludes that the quality of analysed documents is not on a satisfactory level. In that regard, this paper also contains a set of recommendations focused on enhancing the quality of indictments and verdicts, as well as clarity and accuracy of legal provisions related to their content.
